EMBER END USER LICENSE AGREEMENT

This agreement is between you and the developer of Ember ("we", "us") and
covers the Ember image viewer for Windows ("Ember", "the software"). By
installing or using Ember you agree to these terms. If you do not agree,
do not install or use Ember.

1. FREE PERSONAL LICENSE

Ember is free for personal, non-commercial use by private individuals.
This covers your own photos and your own devices, for any use that does
not make money and is not on behalf of an organization.

The free license also covers:

  - Educational institutions such as schools and universities, for
    teaching and study.
  - Museums and libraries.
  - Registered charities and non-profit organizations.
  - Evaluation of commercial use for up to 30 days.

2. COMMERCIAL LICENSE

Any commercial or organizational use of Ember requires a paid license,
one per user. This means:

  - use by or within a company, government agency, or any other
    organization, including organization-managed devices and use in the
    course of employment; and
  - use by self-employed individuals, freelancers, and sole proprietors
    as part of paid work, such as professional photography.

In short: if you make money using Ember, you need a license.

Commercial licenses are arranged directly by email. Contact
license@emberviewer.com with your name or company name and the number of
users, and we will provide an invoice and a license certificate. Until
your purchase is completed, the 30-day evaluation period in section 1
applies.

3. REDISTRIBUTION

You may share unmodified copies of the official Ember installer or
portable package free of charge. You may not sell Ember, charge for its
distribution, or bundle it with other products without our written
permission.

4. RESTRICTIONS

You may not modify, decompile, or reverse engineer Ember except to the
extent expressly permitted by applicable law, remove or alter any
copyright or license notices, or misrepresent the origin of the software.

5. OWNERSHIP AND THIRD-PARTY COMPONENTS

Ember is licensed, not sold. The software is copyright (c) Andrew
Basarab. Ember includes third-party components that are licensed under
their own terms; see THIRD-PARTY-NOTICES.txt, which is distributed with
the software.

6. UPDATES AND CHANGES TO THESE TERMS

This agreement applies to the version of Ember it is distributed with.
Future versions may be distributed under revised terms; the version you
already have keeps the terms it shipped with.

7. PRIVACY

Ember does not collect telemetry, usage analytics, or personal data. The
built-in updater contacts our update server only to check for and
download new versions; automatic update checks can be switched to
notify-only or turned off in Settings.

8. NO WARRANTY

Ember is provided "as is", without warranty of any kind, express or
implied, including but not limited to the warranties of merchantability,
fitness for a particular purpose, and non-infringement.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall we
be liable for any claim, damages, or other liability, whether in an
action of contract, tort, or otherwise, arising from, out of, or in
connection with the software or the use of the software.

10. TERMINATION

This license terminates automatically if you breach its terms. On
termination you must stop using Ember and remove it from your devices.

11. GOVERNING LAW

This agreement is governed by the laws of Ukraine, without regard to its
conflict of law provisions.
